Terms & Conditions of Use
  1. In these terms and conditions VP refers to ViralPublisher.com and its promoters and operators. You refers to the user of this site whether or not a fee is charged in exchange for the use of facilities provided by ViralPublisher.com


  2. You undertake ot maintain a current email address on record at ViralPublisher.com and to accept email notifications from VP at that address relating to but not limited to updates of services provided at VP.


  3. You are responsible for the content you use to create PDF files at VP. By using these files at VP you assert that you have the legal right to use them and are not infringing copyright


  4. All dollar amounts appearing on VP and in these terms and conditions refer to United States Dollars.


  5. VP takes copyright very seriously any allegation of copyright infringement will result in the immediate removal of the offending file from our servers. If copyright violation is established to VP's satisfaction the account of the user involved will be cancelled with no refund of any fees paid. Any affiliate commissions owing will also be forfeited.


  6. You may not upload any content of an explicit sexual nature on to VP. Any content which promotes racism or hatred in any form will also not be permitted on VP - VP will be the sole arbiter of what is permissible content.


  7. Your membership entitles you to upload up to 40 files comprising images and text files for the purpose of creating PDF's or brandable PDF. Each such file may be up to 100 Kb in size. These limits may be varied at any time without notice.


  8. While every effort is made to provide a continuous and uniterrupted service VP does not guarantee 100% uptime.


  9. VP will back up files periodically. However, server crashes can and do happen and it is your responsibility to ensure that you maintain copies/back ups of all files you upload to VP. VP accepts no responsibility for loss of your data or any financial or other loss you may incur as a result of the use of services and products offered at VP or data loss or interruption in service at VP. VP's liability for any damages arising from its relationship with the user howsoever caused whether through negligence or otherwise will be limited to a refund of the current month's membership fee if any. Under no circumstances will VP or its promoters and operators be liable for any consequential losses or loss of profits arising from the the use of a service or product provided by VP or an interruption in service for any reason whatsoever.


  10. You may cancel your membership at any time. This will result in immediate and permanent removal of any files you may have uploaded or created at VP. All download links related to your products will also cease to function immediately upon cancellation or within such time as VP shall determine.


  11. Use of Unsolicited Commercial Email (UCE) or SPAM is strictly prohibited in connection with any activities on VP. Your account will be terminated immediately on receipt of a complaint of spam. Any monies owing to you will be forfeited and no refunds will be made of any fees paid


  12. Affiliate Program - Upon joining VP you are automatically enrolled in the members only Affiliate Program. You will earn a commission on every membership fee received from or direct product sale that originates from a link with your unique affiliate tracking ID. Your affiliate ID is different from your VP username. Your Affiliate ID and link is displayed on your profile page in the members area. No commissions will be payable unless the appropriate link and Affiliate ID is used to send visitors to VP.


  13. A direct product sale is defined as sale where proceeds of the sale are received directly by VP or its promoters and does not include third party products or services that VP may recommend or refer to its membership from time to time.


  14. Commissions are currently paid at the rate of 50% of membership fees or direct sales proceeds after deducting payment processing fees and excludes postage and handling or administration fees charged to the customer.


  15. Commissions are paid through Paypal and will be paid when an $20 or more in commissions have accumulated. It is your responsibility to ensure you provide us with a valid paypal email address. This information can be updated through your profile page in the member area. You are responsible for payment of any paypal fees relating to payment of your commission


  16. Commissions are paid by the 15th day of the end of the month to which they relate and are paid only out of cleared funds available. Cleared funds are defined as monies not subject to refund, dispute or other hold or lien and available for withdrawal into the bank account of the promoters/operators of VP. No commissions are payable on refunds. If commissions have been paid on an amount that is subsequently refunded the commission overpaid will be deducted from subsequent commission payments. Any shortfall where subsequent commissions are insufficient to cover the amount to be recovered will be recovered as a debt due to VP.


  17. You may not use unsolicited email (SPAM) to promote VP's Affiliate Program.


  18. Affiliates are not employees of VP and are responsible for payment of any taxes they incur on transactions with VP. You are also obliged to comply with all legal requirements applicable in your country of operation.


  19. VP reserves the right to change these terms and conditions at any time without notice.


  20. VP reserves the right to discontinue this service at any time without notice.


  21. We log all attempts to circumvent security on the site. Any attempt to breach security will result in immediate termination of your account and formal complaints being lodged to relevant authorities
